12. Witnesses testified that when they saw Byron, Justin and Kelly (supposedly after the murder took place), everyone acted normal...even cheerful. Kelly's version of events had her in shock and Justin shaking and crying. Did both of them recover their composure so completely in less than one hour?
Answer: We don’t know how many times this has to be reiterated: the jury had instructions as to making their own judgments on each witness’ veracity, and it did not find those TWO witnesses who testified on Case's behalf to be believable. These were the same two witnesses mentioned in questions seven and twenty, whose testimony was shown on cross-examination to be tainted by their having access to nearly all trial documents before the trial, and having tailored their testimony on the stand to differ in subtle but important ways from their original statements.Sources: Tesimony and cross-examination of Abraham Kneisley and Tara McDowell (specifically cross-examination), State v.
